
When it comes to e-discovery, an ounce of prevention is truly worth a pound of savings! It can also be the difference between WINNING and losing a case. The most common (and costly) mistake in discovery is the failure to properly assess and plan for a good electronic discovery process. E-discovery generally follows a lifecycle that becomes progressively more expensive as data moves through the lifecycle (see “EDRM Model”). Lack of planning, mistakes or poor decisions on the front-end can have exponential cost and risk consequences on the back-end. This is particularly the case with data preservation and collections where decisions can rarely be “un-done” later.
